Privacy Policy

This privacy policy applies to all applications, services, and websites offered by The Resonance Labs LLC, a Washington limited liability company (referred to as “us,” “we,” “our”), which applications, services, and websites will be collectively referred to as “Resonance” in this privacy policy. By using Resonance, you agree to be bound by the terms of this privacy policy.

You can withdraw from this agreement by sending an email with a request to terminate your agreement with us at support@theresonancelabs.com.

Resonance is a social network for music – allowing you to experience music with friends and family. To make this happen, we collect certain information from your device, use the information in generating content and recommendations on Resonance and selectively share this content and recommendations with your social network.

Your privacy is important to us. We recognize your right to confidentiality and are committed to protecting your privacy. We use the information that we collect to provide you with the best experience possible in offering personalized music content and recommendations and to communicate with you about our products and services.

The data collected by Resonance varies depending on how you use Resonance. For the purposes of data collection, the use of Resonance can be differentiated into whether a user is logged in with their Facebook Account on Resonance (“Logged In”) or not (“Logged Out”).

1. Information We Collect for Analytics

In order to better design the experience and diagnose technical issues, we collect anonymized information about your usage of Resonance and the performance of Resonance, which may include, but is not limited to, buttons pressed, screen time, library statistics, and music played (“Analytics Data”). This Analytics Data is collected regardless of whether the user is Logged In or Logged Out. Analytics Data collection can be disabled from the Settings menu in Resonance.

2. Information We Collect for Generating Content and Recommendations

We collect different types of data for generating content and recommendations in Resonance. Representative use cases include but are not limited to the following:

In order to generate personalized recommendations for a user’s library, data about a user’s library contents such as artists, albums, songs and playlists in the user’s iTunes library (“Library Data”) are collected anonymously. The collection of Library Data is ephemeral (not stored in a database) and anonymized and happens regardless of whether the user is Logged In or Logged Out. Users will be prompted to provide Resonance with consent to access the user’s iTunes library and Apple Music Subscription information.

3. User Accounts

When setting up an account with Resonance, a user will log in with their Facebook account. During the initial log in, the user will be asked to determine what Facebook account data can be shared with Resonance. You can review Facebook’s policies to learn more about allowing access to your Facebook account. Generally, Resonance requests access to the following information and may request access to other information from time to time:

Collectively, the information shared by Facebook if referred to as “User Profile Data”. User Profile Data is recorded in a database and is used to personalize a user’s and their friends’ music content and recommendations.

If a user is Logged In, data on what songs they are playing is automatically collected with user details as the user plays songs (“Song Play(s)”). This collected information is stored in databases and combined with other song plays to generate personalized music content and recommendations for the Logged In user and their friends.

When Logged In, a user can view, play, and interact with the music content and recommendations generated by Resonance. The interactions are in a social context and include, but are not limited to, commenting on a friend’s Song Play, Heart a friend’s Song Play, Singing Along a song for their friends, or Resonating a friend’s Song Play. These interactions generate social data which includes the user generated content and the social context (“Social Data”). This Social Data is recorded in a database and shared with the user’s friends and the users involved in the social context.

Regardless of whether a user is Logged In or Logged Out, users can search for music in Resonance and the search will generate ephemeral and anonymized user generated search data (“Search Data”). The Search Data is then used to generate search results and music recommendations for the user.

Regardless of whether a user is Logged In or Logged Out, users will be prompted to provide Resonance with consent to send them notifications including but not limited to alerts, sounds and icon badges. If the user allows Resonance to send notifications, we may record "Notifications Data" in the database, including but not limited to device identifier and device notification token. This data is recorded non anonymously when user is logged in. This data is recorded anonymously when user has never logged in, however, it is recorded non anonymously when the user is logged out but has previously logged in (or user logins in the future).

Users can set different privacy controls in the Settings menu in Resonance (“Settings Data”). Settings Data is recorded in a database with the user details (and is not anonymous) and is used to personalize the user’s experience with Resonance. This data includes, but is not limited to, email preferences, a list of friends that the user is following, and a list of friends that the user is sharing data with (friends who can see a user’s Song Plays). Settings Data requires users to be Logged In, however, the setting that enables/disables upload of analytics data is accessible when user is Logged Out or Logged In.

Users can invite their friends to join Resonance by sending them a message with a link to Resonance (“Invite Data”) using a messaging application of their choice, including but not limited to, email, SMS, Chat Message, Share on Facebook, or Post to Twitter. This data is recorded in a database by Resonance (anonymously if the user is Logged Out; non-anonymously if user is Logged In) and the third-party applications processing the message may receive and store this data as well. The data sent to the third-party applications from Resonance is the message text and the invite link (if any). Refer to the third-party application’s Privacy Policy on how this data is handled in the third-party application.

Users can share content (such as songs, playlists etc.) with their friends by sending them a message with a link to the shared content (“Share Data”) using a messaging application of their choice, including but not limited to, Resonance, email, SMS, Chat Message, Share on Facebook, or Post to Twitter. This data is recorded in a database by Resonance non anonymously. Share data includes but is not limited to includes shared content metadata, artwork, content previews, sharing user’s facebook public profile and any user generated share content data such as sing alongs / messages.

If the user shares the content on Resonance, the data is visible to the recipients within Resonance only.

If the content was shared on third-party applications, the third-party applications processing the share content may receive and store this data as well. Refer to the third-party application’s Privacy Policy on how this data is handled in the third-party application. The shared content (and in some cases cancelled attempts to shared content) is visible publicly using the generated link on a web page maintained by Resonance for the recipient to view and listen to. This is for cases such as the recipient does not have Resonance installed on the device, they view the shared content on a non supported device or intend to view the shared content in a web browser.

Users can be redirected to the iTunes store by Resonance to buy songs or an Apple Music subscription, which creates “Buying Data”. Buying Data is recorded in the database with the user details and the buying context, including but not limited to song data and subscription data.

4. Personal Information from Minors

We do not offer our services to, or target, persons under the age of 13. In compliance with the Children’s Online Privacy Protection Act, we will remove any information we receive from people we believe to be under the age of 13 from our database and cancel any corresponding accounts.

5. Data Usage

Collectively, the different types of data discussed above, including “Analytics Data”, “Library Data”, “User Profile Data”, “Song Play” Data, “Social Data”, “Search Data”, “Settings Data”, “Invite Data”, “Share Data” and “Buying Data,” are referred to as “User Data”. We use User Data to create your account, provide our services to you, communicate with you about our services, offer additional third-party products and services, and to enforce our terms of service. Representative use cases include but are not limited to the following:

Ephemeral and anonymized “Library Data” is combined with other data from Resonance to generate personalized music recommendations for the user’s library. Library Data is not shared with a user’s friends.

User Profile Data is used in conjunction with Song Play data, Social Data, Search Data, and Library Data to generate personalized music content and recommendations for the user. User Data is also used to deliver a personalized music experience for user’s friends.

Song Play data is shared to generate a personalized music experience for users’ friends and may be visible to users’ friends and their friends in some cases.

Social Data is visible to the friends of the user who generated the social data and the friends of the users in the social context including but not limited to Song Play user, commenting users, and other Social Data users.

Search Data is used to generate search results and recommendations for the user and is not shared with a user’s friends.

Notifications Data is used to send user notifications including but not limited to alerts and music recommendations. Notification's data is not shared with a user's friends.

Share Data, if the user shares the content on Resonance, is visible only to the sender and the recipients within Resonance.

Share Data, if the user shares the content on a third-party application, is shared with the third-party application with an intent to send the link to shared content to the recipient. Refer to the third-party application’s Privacy Policy on how this data is handled in the third-party application.

Share Data (and in some cases cancelled attempts to shared content), if the user shares the content on a third-party application, is visible publically using the share link on a web page maintained by Resonance for viewing and listening.

Settings Data is used to customize the user’s application experience and is not shared with a user’s friends.

Invite Data is not shared with a user’s friends by Resonance but is shared with the third-party application with an intent to send an invitation to the invitee. Refer to the third-party application’s Privacy Policy on how this data is handled in the third-party application.

Analytics Data is used to improve the customer experience for the users and may be aggregated and analyzed but is not shared with other users.

Buying Data is used to improve the customer experience and the business use case of Resonance. Buying data may be aggregated and analyzed but is not shared with other users.

6. Sharing User Data

6.1 Disclosure of User Data

We will take reasonable steps to protect all User Data against unauthorized access or disclosure. We may share User Data: (i) with our third-party service providers in order to maintain and support Resonance; (ii) with another company if such company acquires our company, business, or assets; and (iii) as required by law and when we believe disclosure is reasonably necessary to comply with a judicial proceeding, court order, or legal process served on us, to protect our rights and the rights of our users, or to enforce or apply our terms of service or other policies or user agreements.

6.2 Notice and Consent for Other Disclosure

Except as detailed above, we will provide reasonable notice and obtain your consent before sharing your User Data with any third parties.

7. Security of User Data

7.1 Reviews and Updates to Security Measures

We take commercially reasonable security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or deletion of User Data. This may include undertaking internal reviews of our data collection, storage, processing practices, and security measures, including secure communications, appropriate encryption and physical security measures to guard against unauthorized access to the systems where we store User Data. In addition, we will restrict access to User Data to our employees, contractors, and agents who need to know certain information in order to process it on our behalf. These individuals and entities are bound by strict confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

7.2 Security Breach

If User Data is compromised as a result of a security breach, we will promptly notify you that your personal information may have been compromised via email, by posting a notice on our website, or as otherwise required by applicable law.

8. Third Parties and Linked Sites

Information collected outside of Resonance by a third-party service provider is governed by the third-party’s privacy policies and their terms and conditions. Resonance may contain links to and from third-party sites and applications. We provide these links solely for your convenience and information. We assume no responsibility for your use of such third-party websites or applications.

9. Conditions of Use, Notices, and Revisions

By using Resonance, you consent to the collection, use, and disclosure of information according to the terms of this privacy policy. We reserve the right to modify this privacy policy at any time. If we make material changes to this privacy policy, we will notify you by providing the updated privacy policy on our website, sending an email notifying users of a change in our privacy policy, and notifying users in the Resonance mobile app. We will take reasonable steps to ensure that you are always aware of the information that we collect, how we use it, and under what circumstances we disclose it. Unless we clearly state otherwise, changes to our privacy policy will affect only the information we collect after the effective date of the change.

10. Data Rights

To request access to the User Data we collected for Resonance, correct or complete incorrect User Data in Resonance, terminate your account and delete the User Data in Resonance, or process other User Data related requests, contact us at support@theresonancelabs.com. We reserve the right to decline the processing of other User Data related requests without assigning a reason. We also reserve the right, if we deem fit, to withhold, obfuscate, omit a part of or complete data for access, correction, and deletion requests for any reason including but not limiting to, protecting the business and its intellectual property.
